HONORABLE JURADO DEL COMITÉ INTERNACIONAL DE ETICA BUDISTA (CIEB) y TRIBUNAL BUDISTA DE DERECHOS HUMANOS (TBDH)

P R E S E N T E . –

 

En la presencia del Presidente y Guía Espiritual del CIEB-TBDH Maestro Budista Maitreya, y de la Secretaria Ejecutiva del CIEB-TBDH Maestra Yan Maitri-Shi, se aborda el Caso denunciado por la International Association of Maitriyana (IAM) frente al LAMA OLE NYDAHL por el Delito de DISCRIMINACION.-

 

Sekkha Dhamma, en cuanto Fiscal del CIEB y el TBDH, reconozco el arduo y organizado trabajo que se realizó para la amplia recopilación de Pruebas en este caso, de igual forma, agradezco la aportación de las mismas para el análisis que concierne a la Parte que represento. Dicho esto, con el debido respeto comparezco a exponer:

Recibido el listado de medios digitales que fueron reunidos, ordenados y a la vez confirmados en su orden y contexto como Pruebas por parte de la Secretaria Ejecutiva del CIEB y TBDH Maestra Yan Maitri-Shi, doy paso a la Tercera Etapa del Procedimiento denominada: “VALORACION DE LAS PRUEBAS”, misma que se establece en el Acta Constitutiva del CIEB y TBDH para efecto de conocer, establecer, dictaminar y determinar la Responsabilidad por la comisión del Delito de DISCRIMINACION cometido por el Acusado LAMA OLE NYDAHL. Esta Acusación fue realizada por la INTERNATIONAL ASSOCIATION OF MAITRIYANA (IAM) en el ámbito de la Ética Budista, acto que sigue a continuación:

 

VALORACION DE PRUEBAS

PRIMERA VALORACION.- Al ser la parte medular de esta parte procesal, es necesario señalar los Medios Probatorios ofrecidos por la Secretaria Ejecutiva del CIEB y TBDH Maestra Yan Maitri-Shi, y presentarlos formalmente al Jurado para su conocimiento, mismos que se componen de 9 Evidencias que validan la Acusación motivante del actual proceso, intitulada con el Delito de DISCRIMINACION a cargo del Acusado. Lo anterior denunciado desde el campo de la Ética Budista. Estas Evidencias provienen de medios digitales audiovisuales y enlaces de internet de dominio público (medios de comunicación), mismos que se enlistan a continuación:

 

 

  1. DISCRIMINATION AGAINST MUSLIMS AND AFRICAN PEOPLE

Ole Nydahl: “(…) where you have to believe a lot of things because you can’t know them, then you try to convince others in order to convince yourself, especially if you have a terrible god like Allah making you do criminal things.” (…) “Judaism and Christianity are fine. Islam, I warn against. I know the Koran, I know the life story of Mohammad and I think we cannot use that in our society today. People like the Sufis and Bahá’ís are different, right. They are usually being killed as soon as the mainline Muslims come in, they start killing the other guys. (…) They want you to believe just because it’s said, and you should not have any proof. (…) We have about 600 [schools] now, worldwide. Nothing in Africa because… well, they’re probably not in an abstract mindset right now.   1. SEXISMO, DERECHISMO y HOSTILIDAD

Oliver Freiberger: “Nydahl ha sido acusado no solo de hablar en un tono militarista, sino también de ser derechista, racista, sexista[1] y hostil a los extranjeros”[2]

Ole Nydahl: “la mejor manera de enfrentar los grandes problemas del mundo es pagarle a las familias pobres alrededor del mundo (a las mujeres) para que no tengan más de uno o dos niños y ayudarlos a educar a los hijos que tienen”[3] (https://es.wikipedia.org/wiki/Ole_Nydahl, Fuente: Wikipedia.org)

 

  1. ANTI-ISLAMISMO

Ole Nydahl: “Tengo dos miedos sobre la situación mundial: la sobrepoblación y el Islam. Esas dos cosas pueden destruir el mundo, el cual de otra forma sería un hermoso lugar.” (…) “Podemos tratar de civilizarlos. Es decir, el mundo islámico y la opresión de la mujer – los hombre que oprimen a las mujeres probablemente serán mujeres oprimidas en su próxima vida.”[4]

Ole Nydahl: “El maestro debe actuar de la misma forma que habla. No debe simplemente evitar temas conflictivos, sino apuntar a las causas de posibles problemas en el futuro como la sobrepoblación en los ghettos y los países pobres, y el crecimiento del Islam.”[5]

 

  1. BUDISMO SUPERFICIAL

Jørn Borup, a professor of religion: “[Nydahl] and his Diamond Way Buddhism is in no way representative of Buddhism, Tibetan Buddhism or the teachings of the Karma Kagyu lineage.”[6]

Martin Baumann, a professor of religion. “when I listen to his [Nydahl’s] alarmingly superficial formulations in his talks I can understand his critics who say that he is presenting a watered-down ‘instant Buddhism’, a sort of ‘Buddhism light’ for the West.”[7]

Burkhard Scherer: “Nydahl’s reception in academia begins with a critical paragraph in Stephen Batchelor’s 400-page work on Buddhism and the West (published in 1994). A Buddhist teacher and westernizer of Buddhism himself, Batchelor describes Nydahl as “one of the Karmapa’s most effective, albeit controversial, agents in Europe”, a “sun-tanned Viking” projecting an “ecstatic, sensuous version of Tantric Buddhism,” whose approach shows “fundamentalist and sectarian overtones” (p. 115). (…) In an earlier sociological study devoted to Kagyu converts in Germany, Eva Saalfrank noted the same criticism of “instant-enlightenment” and “instant-Buddhism” referring to Nydahl’s teaching of advanced tantric practices (Saalfrank 1997: 138).”] (http://www.globalbuddhism.org/10/scherer09.htm )

 

  1. HOMOPHOBIA

BURKHARD SCHERER, a professor of comparative religion and a student of Thaye Dorje, as well as a former student of Ole Nydahl, said in his workMacho Buddhism: Gender and Sexualities in the Diamond Way: “Nydahl admits feeling uncomfortable with the idea of ‘two gentlemen kissing.’[8] In his hagiographical account Riding the Tiger, which recounts the early charismatic, missionary phase of the Diamond Way movement, Nydahl utilizes ‘homosexuality’ as a narratorial punchline in order to exemplify the confused state of mind of the (post-)hippie generation (…) Nydahl’s modernist (and potentially colonialist) recourse to secular, universal rights and values seems to be in contradiction with his squeamishness about homosexuality, since LGBTIQ (lesbian, gay, bisexual, transgender, intersex and queer/questioning) rights could be argued to be an integral part of what Nydahl essentializes as Human Rights. (…) He (Ole Nydahl) admits that he used to think homosexuals to be ‘a bit funny’[9] (…) Still, in a question-and-answer-book published in Hungary in 1998, he more or less equates homosexuals with ‘sexual extremists’[10] (…)in 2001, in an interview given to a German language magazine in Los Angeles, Nydahl states that homosexual relationships are ‘not advised’ in Buddhism since ‘they seem to bring more suffering, disease and disturbing emotions than normal relationships’[11]. (…)Even in more recent statements, Nydahl continues homophobic stereotypes when warning against ‘them’ spreading diseases[12] or even ‘chasing kids,[13] assuming the popular conflation of homosexuality with pedophilia. (…) Another issue of contention is gay marriage. In those countries which recognize the Diamond Way as a church or official religion (Denmark, Austria, Poland, Hungary and Russia), Nydahl is legally authorized to officiate at weddings.   1. ACUSACIÓN DE QUE EL ISLAM ES GENOCIDA

Lama Ole Nydahl: “el Islam ha matado en los últimos cientos de años a 170 millones de personas. El número más grande en África. (…) Hoy en día, el problema más grande es el Islam y la superpoblación. Sobrepoblación de uno u otro lado porque a la gente no le dan suficientes proteínas en su cerebro, no le ofrecen las posibilidades suficientes para desarrollarse. Entonces tienen que tener un terrible trabajo que no les gusta, que no les trae satisfacción. (…) El Dios cristiano da consejos, el Dios islámico da mandamientos.   1. MUSLIMS AND CHRISTIANS PROTESTING AGAINST OLE NYDAHL

[“On Tuesday evening, Lambeth council’s planning committee approved the plans for the former Beaufoy Institute, in Black Prince Road, Kennington, to become the Diamond Way Buddhism (DWB) organisation. (…) However, more than 40 protesters from the Lambeth Muslim Forum and the Lambeth Interfaith Network protested outside Lambeth Town Hall, in Brixton Hill amid claims the organisation is anti-Muslim and anti-Christian. (…) Objections to the new use of the Grade II listed building also came from the Lambeth Against Racism and Islamophobia group and Vauxhall MP Kate Hoey (…) Toaha Qureshi, a member of the Lambeth Muslim Forum and trustee of the Stockwell Mosque, in Stockwell Green, believed Lama Nydahl’s comments amounted to hate speech”.   1. FOLLOWERS OF NYDAHL JOIN WITH SKINHEADS AGAINST BUILDING A MOSQUE

[“A reader from Poland has drawn our attention to the rather bizarre fact that a Buddhist organization played a leading role in the protest. The organization is called Diamond Way and is headed by a Dane named Ole Nydahl. Our correspondent tells us that “members of the Diamond Way organization were prominent in TV coverage of the demonstration against the mosque”. (…) Indeed, the Polish journalist Robert Stefanicki reports that Europe of the Future is headed by the former president of Nydahl’s organization in Poland. Stefanicki adds: “Other supporters of Europe of the Future are Mlodziez Wszechpolska (All-Polish Youths) – ultra right group with hardly hidden fascist attraction, as well as other islamophobic right wingers. [“Today in Warsaw we had a pocket-size demonstration against construction of a new mosque, only 2nd in capital and 5th in Poland for our approximately 15,000-30,000 Muslims. (…) Protests are led by previously unknown group Europe of the Future. It is headed by the former president of Karma Kagyu Buddhist Association – for those readers not familiar with divisions inside Western Buddhism: they are faithful to Ole Nydahl, teacher from Denmark, controversial but very influential in all Europe. Lama Ole is known of his racist views; questioned what would be greatest disaster for him, says: “Islam in Europe”, and “Muslims do not behave in civilized way” in his opinion.   1. CULTO A LA PERSONALIDAD

En el siguiente video (https://www.youtube.com/watch?v=p5S_PP8yxxw ), el cual es llamado Transmisión, puede observarse que en todas las historias que narran los testimonios nunca se hace alusión a ninguna enseñanza budista que Ole Nydahl haya transmitido a sus seguidores, sino que más bien todos ellos hacen alusión a experiencias o anécdotas personales en las cuales depositan una gran cuota de fascinación hacia la figura o persona de Nydahl, lo cual es una evidencia no sólo de un culto a la personalidad sino también de que la práctica que se imparte es bastante similar a los grupos de Autoayuda, demostrándose asimismo que se trata de un abordaje superficial del Budismo.-

 

 

SEGUNDA VALORACION.- De las Pruebas aportadas no cabe la menor duda sobre la autenticidad de las mismas, considerando su procedencia, pues cada testimonio recopilado proviene de un enlace de internet donde se encuentra la información correspondiente que respalda y robustece la evidencia a través de un artículo. Sobre todos los artículos que se ofrecen como probanza y que además se etiqueta en los mismos el Delito compuesto de declaraciones y acciones verbales expresadas por el Acusado (caso que no ocupa ni compete conocer ni decidir “jurisdiccionalmente” por nuestra Parte en este Caso de Ética Budista), no hay objeción, descalificación o invalidación del contenido digital por la Parte que represento, en virtud de que son medios digitales que proceden de fuente digna y que además se declararon y publicaron en su momento de manera formal y abierta, de las cuales no cabe duda sobre su autenticidad o veracidad, a menos de que sean objetados debidamente en este Caso por el Acusado.-

TERCERA VALORACION.- Por lo expuesto, publicado, declarado y reproducido en los medios de comunicación y que ahora son presentados como Prueba Digital para este caso por la Secretaria Ejecutiva del CIEB y TBDH Maestra Yan Maitri-Shi, se determinan dichas probanzas por la Parte que represento en cuanto Fiscal del CIEB y TBDH como LEGITIMAS y VALIDAS, mismas que respaldan y confirman la Acusación que presenta la International Association of Maitriyana (IAM) frente a LAMA OLE NYDAHL por el Delito de DISCRIMINACION.-

En tal situación, se da inicio a la Cuarta Etapa del Procedimiento denominada “CONTESTACION”, en la cual se establece el término de 5 cinco días a la Parte Acusada y Requerida LAMA OLE NYDAHL, a fin de que emita la Contestación que desee o le corresponda frente a la Acusación y Requerimiento con respecto a las Pruebas aportadas, aceptadas y valoradas en el presente escrito.-
